CHAPTER V Termination of Tenancy by the Landlord or Tenant
The Jammu and Kashmir (Residential and Commercial Tenancy) Act, 2012 (repealed)
Repealed in the Union territory of Jammu and Kashmir from 15 February 2026 by section 47(1) of the Jammu and Kashmir Tenancy Act, 2025 (Act No. IV of 2025), which reads "The Jammu and Kashmir Residential and Commercial Tenancy) Act, 2012 which is in force immediately before the commencement of this Act, is hereby repealed", with pending cases saved by section 47(2).

Kept for reference only: the Act was repealed from 15 February 2026 by the Jammu and Kashmir Tenancy Act, 2025, and applies now only to cases pending at that date under section 47(2) of that Act.
The landlord shall before recovery of possession of rental unit refund rent and other payment, if any, received in advance from the tenant, where tenant vacates the premises on a notice given by the landlord under clauses I and II of section 21 :
Provided that refund shall be made by the landlord after deducting the rent and other charges due to him within one month of termination of tenancy.
