No patent shall be granted in respect of an invention relating to atomic energy falling within sub-section (1) of section 20 of the Atomic Energy Act, 1962 (33 of 1962).

Section 4: Inventions relating to atomic energy not patentable
The Sustainable Harnessing and Advancement of Nuclear Energy for Transforming India (SHANTI) Act, 2025 (39 of 2025) substitutes this section (Third Schedule to that Act). As on 12 October 2026 no notification bringing that Act into force had been published, so the section below is the one in force.
