For the purposes of Section 5 of the Transfer of Property Act, 1882, the expression "living person" includes:

    1. A. only a natural person, and not a company or any other juristic entity
    2. B. an incorporated company, but not an unincorporated association or body of individuals
    3. C. a natural person or a company, but only where it is a Government company
    4. D. a company or association or body of individuals, whether incorporated or not
    Show the answer

    D. a company or association or body of individuals, whether incorporated or not

The second paragraph of Section 5 TPA provides that "living person" includes a company or association or body of individuals, whether incorporated or not, while leaving untouched any law relating to transfers to or by such bodies.

  2. Question 2 · Transfer of Property Act Practice Set 1

Section 6(h) of the Transfer of Property Act, 1882 bars a transfer for an unlawful object or consideration within the meaning of:

    1. A. Section 25 of the Indian Contract Act, 1872
    2. B. Section 23 of the Indian Contract Act, 1872
    3. C. Section 10 of the Indian Contract Act, 1872
    4. D. Section 24 of the Indian Contract Act, 1872
    Show the answer

    B. Section 23 of the Indian Contract Act, 1872

Section 6(h)(2) TPA provides that no transfer can be made for an unlawful object or consideration within the meaning of Section 23 of the Indian Contract Act, 1872, the section that states which considerations and objects are lawful and which are not.

  3. Question 3 · Transfer of Property Act Practice Set 1

Consider the following statements regarding Section 10 of the Transfer of Property Act, 1882: 1. A condition in a lease absolutely restraining the lessee from assigning his interest, where the condition is for the benefit of the lessor, is not void under Section 10. 2. Section 10 applies only to transfers of immoveable property. 3. Property may be transferred to or for the benefit of a woman (not being a Hindu, Muhammadan or Buddhist) so that she shall not have power during her marriage to transfer or charge it. Which of the statements given above is/are correct?

    1. A. 1, 2 and 3
    2. B. 3 only
    3. C. 1 and 3 only
    4. D. 1 and 2 only
    Show the answer

    C. 1 and 3 only

Section 10 TPA saves a restraint in a lease where the condition is for the benefit of the lessor or those claiming under him, and its proviso permits a restraint on anticipation in favour of a woman who is not a Hindu, Muhammadan or Buddhist. Section 10 falls in Part (A) of Chapter II, which applies to property whether moveable or immoveable, so statement 2 is wrong.

  4. Question 4 · Transfer of Property Act Practice Set 1

During the lifetime of his father F, S executes a deed for consideration in favour of T, transferring "the share in F's house that S expects to inherit on F's death". The house is F's self-acquired property, and T knows that it belongs to F. Under the Transfer of Property Act, 1882, the transfer to T is:

    1. A. valid, but it takes effect only when S actually inherits the share in the house
    2. B. voidable at the option of F, but only so long as F himself remains alive
    3. C. valid, as Section 5 allows property to be conveyed in present or in future
    4. D. void, as a mere chance of an heir-apparent to succeed cannot be transferred
    Show the answer

    D. void, as a mere chance of an heir-apparent to succeed cannot be transferred

Section 6(a) TPA bars the transfer of the chance of an heir-apparent succeeding to an estate (spes successionis), so the deed passes nothing. Section 43 cannot save it here because S made no representation of a present title; the deed itself describes a mere expectancy, which T knew.

  5. Question 5 · Transfer of Property Act Practice Set 1

Section 18 of the Transfer of Property Act, 1882 exempts a transfer of property for the benefit of the public in the advancement of religion, knowledge, commerce, health, safety or any other object beneficial to mankind from the restrictions contained in:

    1. A. Sections 14, 16 and 17
    2. B. Sections 13, 14 and 17
    3. C. Sections 13, 14, 16 and 17
    4. D. Sections 14 and 17 only
    Show the answer

    A. Sections 14, 16 and 17

Section 18 TPA states that the restrictions in Sections 14, 16 and 17 shall not apply to a transfer for the benefit of the public in the advancement of religion, knowledge, commerce, health, safety or any other object beneficial to mankind. Section 13 is not mentioned in it.
